Pa. judge stalls some new shale drilling rules

Giving the Marcellus Shale Coalition time to challenge the state Department of Environmental Protection’s new regulations, Commonwealth Court Judge P. Kevin Bronson stopped the implementation of some of the rules, according to the Pittsburgh Post-Gazette.

The narrow sections of the month-old regulations that will be put on hold include rules related to public resource protections, large fluid holding ponds, well site restoration standards and monitoring for underground hazards around fracking operations. Bronson halted the compliance, finding that some aspects of those select rules might exceed the regulator’s authority and the cost associated with following them might cause the industry irreparable harm.

The DEP is still reviewing the court’s decision
