The Federal Energy Regulatory Commission has denied a recent petition from the Constitution Pipeline, requesting that it overrule New York State’s decision to halt the pipeline, according to Kallanish Energy.
Last October, New York State refused to give the pipeline a needed water certificate. In response, Constitution Pipeline Co. filed a petition with the FERC, asking the commission to find the state’s department of environmental conservation had waived its authority to issue to water permit by failing to act within a statutory limit.
However, the FERC unanimously denied the petition, leaving the pipeline stuck.
