Sen. Manchin secures pledge from Democratic leaders to finish Mountain Valley Pipeline

Senator Joe Manchin III of West Virginia secured a pledge from Democratic leaders and the White House to finish the Mountain Valley Pipeline, a 304-mile natural gas pipeline in his state, according to The New York Times. Manchin won the promise in exchange for his support for a climate tax package.

Democratic leaders have agreed to pass a law to complete the Mountain Valley Pipeline and ease the permitting process for other energy projects. Manchin’s side agreement to secure his support for the climate legislation was struck with Senator Chuck Schumer of New York, the Democratic majority leader, House Speaker Nancy Pelosi and President Biden.

The Mountain Valley Pipeline project has faced extensive delays and pushback from environmental groups, which have had success challenging a series of federal permits for the project in the United States Court of Appeals for the Fourth District in Richmond, Va. The court has overturned permits issued by the Fish and Wildlife Service, the Bureau of Land Management and the Forest Service.

However, Congress has the ability to override the courts and move the project forward. Furthermore, Manchin’s deal would take the case away from the Fourth District and give the United States Court of Appeals for the District of Columbia Circuit jurisdiction over all future legal challenges related to the project.
