Appeals court upholds decision on Rover Pipeline

The 5th District Court of Appeals upheld the ruling of a Stark County judge who dismissed the state’s lawsuit against Rover Pipeline earlier this year, according to The Daily Record.

In regards to the Ohio Attorney General’s Office suit against the pipeline, which alleging environmental violations in more than a dozen counties, Common Pleas Judge Kristin G. Farmer ruled in March that the Ohio Environmental Protection Agency waived its right to regulate the pipeline’s construction under the Clean Water Act.

The judge wrote the state had a year to act on Rover’s inquiry to discharge pollutants under the Clean Water Act, and failed to do so. Instead, the Ohio EPA asked Rover to resubmit its application, which was approved.

In the most recent decision, earlier this month, a three-judge panel voted unanimously to uphold Farmer’s decision.
