Court throws out Mountain Valley Pipeline’s West Virginia water permit

The Mountain Valley Pipeline has lost its West Virginia water permit after a federal appeals court ruled that the state didn’t adequately assess the impacts of building it across streams and wetlands, according to The Washington Post.

The court decided the West Virginia Department of Environmental Protection’s justification for its 2021 water certification was “deficient.”

The decision is a major setback for the Mountain Valley Pipeline, which received a major win last month when a federal court upheld a crucial water permit for the project in Virginia.
