Pa. natural gas drillers face impacts fees following court ruling

Natural gas drillers in Pennsylvania are expected to take responsibility for millions of dollars in unpaid state “impact fees” following a ruling by the state Supreme Court, according to WITF.

Pennsylvania utility regulators are generating invoices for some 17 shale gas producers that had challenged fees on some of their wells amid a legal dispute with the state.

Drillers argued for a more expansive definition of what counts as a “stripper well” — a well that is nearing the end of its life — to include more wells that could be exempt from impact fees. However, the Supreme Court disagreed.

The Public Utility Commission estimates the decision involves hundreds of wells and millions of dollars in fees. An industry group plans to advocate on behalf of the natural gas companies facing the fees and ask the justices to reconsider.
